Bouncy Castle, Inflatable equipment and Marquee Terms of Hire

These are the Terms and Conditions of hire, please ensure that they are followed at ALL TIMES to ensure the safe operation an use of our equipment. Please be aware that Crown Castles will NOT be held responsible for any injury or damages in the event that these terms and conditions are ignored.

1. PAYMENT

Certain hires may be subject to a non-refundable deposit at the companies’ discretion on an individual hire basis. In the event that a deposit is taken and the hirer has cancelled the company will allow the value of this deposit to redeemed against the total cost of another hire. In this case, an additional deposit may also be required to secure the booking and will be non-refundable.

The full balance must be paid on or before delivery or by bacs payment or cash/ debit card (a surcharge of £1.50 is required for card payments. If elected to pay by cash this must be paid upon arrival when the equipment is set-up.

We cannot accept cheque payments upon delivery unless this has been agreed at the time of booking. Exceptions will be made for schools, charities, and government funded organisations.

The company reserves the right to charge interest on any overdue balance at a rate of 8% per annum above Bank of England base rate. For a customer that defaults on payment then the company reserves the right to pass on this debt obligation to a debt recovery agent. This may incur additional administration/ agent fees for which the company will be entitled to full reimbursement at the disbursement of the hirer.

2. INSURANCE

The hirer will be responsible for any damages or injuries sustained as a result of misuse, over boisterous behaviour, improper supervision or any other circumstance where the terms and conditions have not been adhered to as described in section 10 (Hirers Responsibilities). It is also the hirers responsibility to take all due care to avoid damage to the equipment or theft of the equipment as a result of misuse or negligence.

The company insurance will not cover any risks associated with theft, loss of equipment, wanton damage or vandalism. As such the hirer will be responsible for the replacement cost of any equipment where these terms are not adhered to. Security of unattended equipment is the sole responsibility of the hirer regardless of ownership of land and delivery location.

The Company public liability insurance covers up to the value of 5 million pounds sterling and will only be valid if all terms and conditions are adhered to.

3. SERVICES FIXTURES AND FITTINGS

The Company will not be held responsible for the damage to any fixtures, fittings or services as a result of delivery, erection or use of our equipment. It is the hirer’s responsibility to identify and provide the company with the location of any underground services that may be damaged by anchor stakes which are used to secure equipment to the ground.

Furthermore, the hirer must ensure that all delivery access areas are free of obstacles, debris or any other structure which may impede the safe delivery and entry of goods and services to the delivery location. In addition, the hirer will be responsible for any costs associated with the repair and/or replacement costs for any fixtures, fittings and services as described above.

4. WEATHER

In the event of poor weather conditions the company reserves the right to refuse installation and use of our equipment. This will be at the discretion of the company with the view to ensuring the full safety of all parties involved. In the event that a hire is cancelled due to poor weather then the company reserves the right to withhold any deposits. For events that are cancelled with little notice on the grounds of poor weather conditions the company will not be held responsible for any damages relating to the absence of our equipment. Insurance can be purchased to compensate for this and should be sought prior to the date of hire.

6. POST INSTALLATION

When the equipment has been installed at the agreed location, this should not be altered or moved by anyone other than a company employee. Failure to observe this instruction will void insurance cover.

7. DISCLAIMER

The hirer is responsible for signing a completed disclaimer which describes the responsibilities and duties of the hirer whilst the companies’ equipment is in operation. These responsibilities will apply separately for the hire of “Marquee” equipment or “inflatable” equipment or both as described in section 8 and 9 respectively.

8. INFLATABLE HIRERS RESPONSIBILITY

“Inflatable” refers to any Bouncy Castle, Bouncy Slide, Assault Course, Gladiator Duel/Pole Joust or any combination of the above or subcontracted asset not mentioned herein. These are the responsibilities of the hirer for inflatable equipment and should be obeyed at all times.

  1. Shoes must be removed before use to avoid injury or damage to the inflatable.
  2. Remove all footwear, jewellery and glasses prior to using the inflatable.
  3. Do not enter the inflatable with food or drink.
  4. Each inflatable unit has an age/ height restriction which will be visible on the castle label. Please ensure this age/ height limit is abided by at all time.
  5. Avoid larger participants entering the inflatable with smaller participants. In the case that younger children and older children/ teenagers wish to participate, a separate inflatable should be considered or crowd control measures should be implemented to avoid collisions.
  6. A responsible adult should supervise all equipment at all times. Crown Castles staff will give safety instructions upon delivery. It is the sole responsibility of the hirer to communicate this to all users.
  7. Avoid overloading Bouncy Castle/ Inflatable at all times – obey the maximum no of user restrictions.
  8. Children using our inflatables should be no taller than the walls of the castle.
  9. For inflatables that are erected outdoors on hard standing surfaces the equipment must be secured to the ground with sufficient weight. This can be done by attaching sand bags or water weights. It is the customer’s responsibility to advise us of any requirements for sandbags or water weights prior to the hire date. Failure to do so will void all insurance.
  10. No boisterous behaviour including ‘wrestling’, ‘tackling’, ‘kicking’ or ‘pushing’.
  11. In the event of heavy rain, it is recommended that the inflatable be switched off. In the case of ‘light’ showers ensure that electrical connections are NOT exposed and that internal surfaces are dry.
  12. Do not use any inflatable in high winds – please turn off and allow to deflate.
  13. Do not allow children to approach the rear of the inflatable and keep away from any electrical equipment. If generator is in use, please use barriers to fully enclose this area.
  14. Ensure that the vent on the side of the blower is kept clear of leaves, bags or any other debris to avoid deflation.
  15. No face-paints, party-poppers, coloured streamers to be used. This will stain the inflatable and will incur a cleaning charge.

9. MARQUEE HIRERS RESPONSIBILITY

These are the responsibilities for the hire of marquee equipment and should be obeyed at all times.

  1. The hirer shall not use any catering equipment, lighting or electrical appliances or decorate the interior/exterior of the marquee without prior consent from the company.
  2. The hirer or any associated individuals not employed by the company must not enter the marquee vicinity whilst the marquee is being erected/ delivered.
  3. The hirer must not tamper with any marquee fixtures or fittings post installation and must not remove any anchor stakes or weights.
  4. For Marquees that are erected on hard standing surfaces the equipment must be secured to the ground with sufficient weight. This can be done by attaching sand bags or water weights. It is the customer’s responsibility to advise us of any requirements for sandbags, water weights prior to the hire date. Failure to do so will void all insurance.
  5. The hirer must not tamper with any electrical appliance or power lead installed by the company including extension reels. Electrical appliances or power leads that are overloaded are a fire risk.
  6. Keep children away from any electrical or mechanical equipment. If a generator or space heater is in use, use barriers to fully enclose this area.

10. LIABILITY

The Company will not accept Liability and you may be liable for full hire fee for the following circumstances:

  1. When the equipment installation/ delivery is cancelled due to the site being inaccessible or in any instance where the site is deemed unsafe by Company representatives.
  2. Delay or cancellation due to the hirer not obtaining appropriate permission from the public or local authority.

10. CANCELLATION POLICY

Cancellations can be made up to 24 hours before any booking is due to be received. To do this the customer must send their request by email, in writing or by calling a member of staff via phone on our land line number 0141 638 9077. Upon request the company will send a cancellation request to the hirer by email or verbally. Any cancellations made within 24 hours of the requested delivery time will be subject to a delivery fee and any deposit will be retained by the company. If the company arrives at the hire destination and the customer has not provided evidence to support their cancellation request, then the hirer will be liable for the full hire charge. In the event that the hirer refuses to pay this charge then the company will pass this to our debt recovery agent as described in section 1.

11. DELIVERY

Delivery will be made by the company to a site requested by the hirer on a specified date for delivery. Time of delivery is approximate unless explicitly agreed in writing by the company. This excludes automated email confirmations. For bookings taken on line, the company will endeavour to achieve your requested delivery time but may be forced to postpone this due to external factors out-with the company's control particularly during peak season. In the event that access to the site will be restricted before the requested delivery time then the hirer should notify the company of this and an additional ‘all day hire’ fee may be applied to guarantee early arrival. For all other hires the delivery times will be interpreted as ‘requested’ delivery times and will not be binding unless agreed in writing by the company. The hirer is responsible for ensuring full and safe access to the delivery site. In the event that the company cannot gain access and there has been no prior of access restrictions then the hirer will be liable for the full hire price as described above.

12. COLLECTION

Collection will be made by the company at the specified delivery location on the date requested by the customer. The time of collection is approximate unless explicitly agreed prior to the hire by the company and the customer in writing. The times requested for collection on booking forms are an indicative collection time only and do not represent any agreement by the company to remove equipment at a specified time. In the event that access to the site will be restricted after a certain time then the hirer should notify the company of this. Otherwise, an additional ‘all day hire’ fee may be levied. For hires requested beyond the last collection time (20:00) then the customer may request that the item be hired overnight for an additional fee. In this instance, the hire item must be situated indoors or in a rear garden with a fenced area so that the units is not visible from the main road. The security of our assets will be at the discretion of Crown Castles staff who reserve the right to remove equipment from the hire site at any time.
